格式合同的產(chǎn)生和發(fā)展是20世紀(jì)合同法發(fā)展的主要標(biāo)志之一，19世紀(jì)中期以來，伴隨著科技的飛速發(fā)展，社會(huì)經(jīng)濟(jì)出現(xiàn)了迅速騰飛，特別是消費(fèi)領(lǐng)域和公用事業(yè)更是一日千里。隨著我國(guó)社會(huì)主義市場(chǎng)經(jīng)濟(jì)的迅速發(fā)展，特別是加入wto后，格式合同以其自身的價(jià)值與特征，被應(yīng)用于社會(huì)經(jīng)濟(jì)的各個(gè)領(lǐng)域，有學(xué)者甚至認(rèn)為格式合同占現(xiàn)代市場(chǎng)經(jīng)濟(jì)發(fā)達(dá)國(guó)家所有數(shù)量的99％，成為當(dāng)今主要的合同形式，也有學(xué)者稱“我們生活在格式合同的世界里”。格式合同的采用，不僅有利于節(jié)約時(shí)間、經(jīng)費(fèi)，減少交易成本，事先分配合同風(fēng)險(xiǎn)，而且可以預(yù)估生產(chǎn)成本促進(jìn)企業(yè)的合理化經(jīng)營(yíng)，對(duì)廣大消費(fèi)者甚為有利。但是，我國(guó)合同法對(duì)格式條款雖有所規(guī)定，但尚欠完善。如何完善公務(wù)員之家版權(quán)所有我國(guó)格式條款制度，值得我們思考。認(rèn)真分析研究格式合同的價(jià)值，制定對(duì)格式合同維護(hù)地政策，進(jìn)行綜合調(diào)控，維護(hù)正義，以保護(hù)處于弱勢(shì)地位的消費(fèi)者，是我國(guó)法制建設(shè)面臨的艱巨任務(wù)，也是對(duì)格式合同價(jià)值與正義維護(hù)進(jìn)行探討的意義所在。本文結(jié)合我國(guó)格式合同的立法實(shí)踐，重點(diǎn)探討了其價(jià)值與不足，并提出了對(duì)格式合同進(jìn)行正義維護(hù)的幾點(diǎn)建議，以便于充分發(fā)揮格式合同的最大價(jià)值，為社會(huì)創(chuàng)造最高的利潤(rùn)，避免消費(fèi)者的利益受到損害，使買賣雙方在盡可能公平的環(huán)境下交易……
